U.S. State Privacy & Consumer Rights + Terms Addendum

Vista Verde Homes – Medicaid Meals Program

This U.S. State Privacy & Consumer Rights + Terms Addendum (“Addendum”) supplements the Vista Verde Homes Privacy Policy, Terms of Use, SMS Policy, and Health Information Disclaimer. It is intended to provide additional disclosures and rights information to individuals residing in U.S. states with enhanced privacy, consumer protection, telemarketing, or data-handling requirements.

This Addendum applies to residents of states including, but not limited to:

California, Colorado, Virginia, Connecticut, Utah, Texas, Nevada, Oregon, Montana, Delaware, Iowa, Tennessee, Florida, and any state that adopts similar privacy or consumer data regulations.

Vista Verde Homes is a 501(c)(3) nonprofit organization. Certain state laws provide exemptions or modified obligations for nonprofits; however, we voluntarily implement transparency and consumer-rights practices consistent with widely recognized privacy standards.

1. Scope of Covered Interactions

This Addendum applies to personal information collected through:

  • vistaverdehomes.org

  • Medicaid Meals eligibility and intake forms

  • Email, SMS, phone, or in-person communications

  • Community outreach events

  • Partner or caseworker referrals

  • Program navigation and resource assistance

It applies regardless of whether services are ultimately received.

2. Categories of Personal Information Collected

Depending on your interaction, we may collect:

Identifiers

Name, mailing address, email address, phone number, state of residence.

Demographic or Household Information

Age range, household size, caregiver status, residency type.

Public Benefit & Eligibility Information

Self-reported Medicaid or Medicare status, general qualification responses.

Limited Health-Related Qualification Data

Non-clinical dietary or support needs used solely to identify appropriate resources.

Communications

Messages, inquiries, form responses, call notes, or support interactions.

Technical & Usage Data

IP address, device type, browser, pages visited, timestamps, referral sources.

We do not knowingly collect full medical records or Protected Health Information (PHI).

3. Purposes for Data Collection

Personal information is used only to:

  • Conduct eligibility pre-screening

  • Provide resource navigation and referrals

  • Respond to requests for assistance

  • Maintain nonprofit operational records

  • Improve accessibility and program effectiveness

  • Comply with grant, audit, and reporting obligations

  • Protect against fraud or misuse

We do not use personal information for commercial advertising or resale.

4. Sale, Sharing, and Targeted Advertising

Vista Verde Homes:

  • Does not sell personal information

  • Does not participate in data brokerage

  • Does not use cross-context behavioral advertising

  • Does not share data for commercial marketing

Any sharing is limited to what is necessary to connect individuals to requested services.

5. Sensitive Personal Information Handling

Certain states require special disclosure regarding sensitive data.

Vista Verde Homes may receive limited self-reported information related to:

  • Public benefit eligibility

  • Dietary support needs

  • Mobility or support requirements

This information is:

  • Used only for referral purposes

  • Limited to the minimum necessary

  • Not used for profiling or automated decision making

  • Not used for commercial purposes

 

6. Consumer Privacy Rights (Where Applicable)

Residents of applicable states may have the following rights:

Obtain a copy of personal data maintained.

Right to Correct

Request correction of inaccurate information.

Right to Delete

Request deletion, subject to legal or reporting retention requirements.

Right to Data Portability

Request information in a usable format where feasible.

Opt out of:

  • Sale of personal information (not applicable)

  • Targeted advertising (not applicable)

  • Profiling with legal effects (not performed)

Right to Non-Discrimination

You will not be denied services for exercising privacy rights.

7. Request Submission & Identity Verification

We may request reasonable verification to protect against unauthorized disclosure.

Responses are typically provided within timeframes consistent with applicable state guidance (generally 30–45 days).

8. Appeals Process

Where required by state law, individuals may appeal denied requests by replying to our response or submitting a new request marked Appeal.

We will review and respond in accordance with applicable regulations.

9. Data Sharing With Service Partners

We may share limited information with:

  • Government agencies

  • Medicaid or Medicare-related programs

  • Nonprofit service providers

  • Community organizations

  • Secure technology vendors

Each entity remains independently responsible for its own compliance.

We do not transfer ownership of personal data.

10. Retention Schedule

Information is retained only as long as necessary to:

  • Provide requested assistance

  • Maintain audit and grant documentation

  • Comply with legal obligations

  • Protect program integrity

When no longer needed, information is securely deleted, anonymized, or archived.

11. Automated Decision Making

Vista Verde Homes does not use automated systems to:

  • Approve or deny benefits

  • Make medical decisions

  • Determine eligibility for government programs

All determinations are made by external agencies.

12. Children & Minor Data

We do not knowingly collect personal data from children under 13 without parental or guardian involvement. Requests involving minors may require additional verification.

13. Telemarketing & Communication Compliance

Vista Verde Homes communications are:

  • Informational and service-related

  • Consent-based

  • Non-commercial

We strive to comply with:

  • TCPA

  • State mini-TCPA laws

  • Do-Not-Call standards

  • CTIA messaging principles

 

14. Accessibility & Equal Access

We are committed to:

  • Non-discrimination

  • Equal access to information

  • ADA-aligned digital accessibility

  • Serving rural, underserved, senior, and low-income populations

 

15. California-Specific Enhancements (CPRA)

For California residents:

  • We do not sell or share data

  • Sensitive data use is limited

  • We honor access, deletion, and correction rights

  • We do not perform behavioral advertising

 

16. Virginia, Colorado, Connecticut & Similar State Rights

Residents may request:

  • Access

  • Correction

  • Deletion

  • Data portability

  • Appeal of denied requests

 

17. Utah & Texas Notice

Although nonprofit exemptions may apply, Vista Verde Homes voluntarily provides:

  • Access and deletion request channels

  • Transparency regarding data use

  • Opt-out from non-essential communications

 

18. Changes to This Addendum

We may update this Addendum to reflect new laws or regulatory guidance. Updates will be posted with the revised date.

We do not determine eligibility, process applications, guarantee approval, or provide meals ourselves—all eligibility decisions, enrollments, and service delivery are handled exclusively by official third-party providers, state Medicaid agencies, managed care plans, case managers, or authorized programs. Participation in any referenced program is entirely voluntary. Individuals retain full freedom of choice in selecting providers, services, or whether to pursue benefits at all.
