New York Program Compliance, Privacy, and Consent Notice

This notice applies to New York State residents and controls over our general policies to the extent of any conflict for those residents.

1. Informational Purpose of This Website

This website provides general information and screening tools to help individuals determine whether they may qualify for community-based services that may be available in New York State, including nutrition supports such as medically tailored meals, health-related social needs (HRSN) services, and other community-based assistance. Completing a screening or submitting information does not guarantee eligibility, program approval, or receipt of services. Eligibility determinations are made by healthcare providers, Medicaid Managed Care Plans, Social Care Networks (SCNs), and other authorized organizations in accordance with applicable law.

2. New York Medicaid Health-Related Social Needs Programs

New York has implemented HRSN initiatives through Medicaid programs authorized under federal and state law, including the New York Medicaid 1115 Demonstration Waiver ("Medicaid Redesign Team"). These programs may include medically tailored meals, nutrition support, housing supports, transportation assistance, community care navigation, and other health-related social services, administered through Medicaid Managed Care Plans, SCNs, healthcare providers, or participating community organizations.

3. Our Role, Neutrality, and Funding in New York

Vista Verde Homes, operating the Medicaid Meals program, is an independent nonprofit information and referral resource. We are not affiliated with, endorsed by, or part of any New York State agency, SCN, Medicaid Managed Care Plan, or the federal government. Our Medicaid eligibility navigation is provided free of charge to individuals. We present available options neutrally and do not recommend, prefer, or steer individuals toward any particular provider or food vendor — you choose your own vendor through the SCN or its portal. We do not charge or accept referral fees, commissions, revenue-sharing, or any payment from food vendors or other providers in exchange for referrals or enrollments. Consistent with New York Education Law § 6530(19) and related fee-splitting restrictions, we do not split fees with, or share professional revenue with, licensed providers.

Where contracted, Vista Verde Homes may perform marketing, outreach, education, or navigation services under an arrangement with a managed care plan or SCN, compensated on a fixed-fee basis that is not based on the volume or value of referrals.

4. Referral to Participating Service Providers

If you complete a screening and appear to meet certain criteria, you may be referred to participating organizations — which may include healthcare providers, Medicaid Managed Care Plans, SCNs, community-based organizations, nutrition/meal providers, and care navigators — for further eligibility review and service coordination. Where more than one option is available, you choose the organization or vendor that fits your needs. Referral does not guarantee enrollment.

5. Social Care Network (SCN) Data-Sharing Authorization

New York SCNs coordinate HRSN services for eligible individuals. By submitting information through this website, you authorize the collection and sharing of relevant information with participating SCNs and associated organizations for eligibility determination, care coordination, service referral, and program administration. Information will be used only for identifying and coordinating services that may support your health and well-being.

 

6. Privacy and Use of Personal Information

Information you submit may include name and contact details, address/location, demographic information, screening responses, and Medicaid coverage information (if provided). It may be shared with authorized organizations involved in determining eligibility and coordinating services. It will not be sold or used for advertising or unrelated marketing. 7. HIPAA Notice

Some organizations that receive referrals may be HIPAA covered entities, and protected health information may be created or shared during eligibility screening and referral. Under HIPAA, you have rights regarding your health information, including to access it, request corrections, request restrictions on certain disclosures, request confidential communications, and receive an accounting of certain disclosures. If services are provided through a HIPAA-covered provider or program, you may receive a separate Notice of Privacy Practices. See our HIPAA Disclaimer.

8. New York Public Health Law Article 27-F (HIV/AIDS-Related Information)

Article 27-F provides special protections for certain health information, including HIV testing, HIV status, and AIDS-related information. Any such information will not be disclosed without appropriate written consent except where permitted by law. You may be asked to provide additional authorization if a referral requires sharing information protected under Article 27-F.

9. Telehealth and Electronic Communication Consent

Eligibility screening, navigation, and referral coordination may occur through telephone, email, video conferencing, secure messaging, or online portals. By submitting information, you consent to electronic communication to contact you and coordinate services. While reasonable safeguards are used, no system can guarantee absolute confidentiality. Participation is voluntary, and you may request alternative communication methods when available.

10. Consent to Contact

By submitting your information, you authorize Vista Verde Homes and participating organizations involved in screening and coordination to contact you using the information you provide, by phone, email, text message (subject to our SMS/TCPA Policy), postal mail, or secure electronic systems, for eligibility screening, referral coordination, and program information. Message and data rates may apply; message frequency varies. You may opt out at any time (for example, by replying STOP to text messages). Consent to receive marketing communications is not a condition of receiving assistance.

11. Medicaid Eligibility Verification

This website does not independently verify Medicaid eligibility. If you indicate you may have Medicaid coverage, verification may be conducted by authorized entities such as healthcare providers, Medicaid Managed Care Plans, SCNs, or participating service providers. Individuals without Medicaid coverage may still be directed to other community programs where available.

12. Non-Discrimination

Programs referenced here are intended to comply with federal and New York State non-discrimination laws. Services are not denied on the basis of race, color, national origin, age, disability, sex, religion, gender identity, sexual orientation, marital status, veteran status, or other protected characteristics.

14. Updates

This notice may be updated periodically to reflect changes in applicable law, regulation, or program requirements. The current version will be posted here with its effective date.

Medicaid Meals serves as an educational, informational, outreach, and referral resource designed to help individuals learn about and connect with community-based services that may be available through Medicaid, Medicare, health plans, Social Care Networks, healthcare providers, community organizations, Health-Related Social Needs initiatives, Home and Community-Based Services (HCBS) waivers, managed care benefits, In Lieu of Services (ILOS) programs, and other authorized assistance programs.

We provide general educational information, non-clinical eligibility navigation, and referral assistance only. We provide information regarding available options in a neutral and non-preferential manner and do not recommend, endorse, prioritize, steer, or require the selection of any particular provider, organization, health plan, meal vendor, or service. Individuals retain complete freedom of choice regarding whether to pursue services and from whom they receive them.

Our eligibility screening and navigation assistance are provided at no cost to the individual. We do not charge consumers for referrals, and we do not accept referral fees, commissions, kickbacks, revenue-sharing arrangements, or compensation tied to the volume or value of referrals, enrollments, recommendations, orders, purchases, or utilization of any item or service reimbursable by a federal healthcare program.

Vista Verde Homes is funded through charitable contributions, grants, donations, and fixed-fee agreements for outreach, education, community engagement, navigation, and administrative support services. Any compensation received is for services rendered and is not based upon whether an individual enrolls in, receives, qualifies for, or utilizes any particular service, provider, health plan, meal benefit, or program.

Medicaid Meals and Vista Verde Homes are not affiliated with, endorsed by, contracted by, operated by, or acting on behalf of the Centers for Medicare & Medicaid Services (CMS), the U.S. Department of Health and Human Services (HHS), any state Medicaid agency, Medicare, Medicaid, or any federal, state, county, or local government entity unless expressly stated otherwise in writing. We do not provide medical care, healthcare services, nutrition counseling, insurance enrollment services, legal advice, financial advice, case management, direct meal delivery, or any other direct healthcare or social services. We do not determine eligibility, approve applications, make coverage decisions, guarantee benefits, process enrollments, or administer government programs.

All eligibility determinations, benefit decisions, enrollments, authorizations, and service delivery activities are made exclusively by independent third parties, including but not limited to Medicaid agencies, managed care organizations, Social Care Networks, healthcare providers, community organizations, case managers, and authorized program administrators. Medicaid Meals and Vista Verde Homes are not responsible for the decisions, actions, omissions, services, performance, availability, or conduct of any third party.

Participation is voluntary. Completion of a screening, inquiry, referral request, or eligibility assessment does not guarantee eligibility, approval, enrollment, benefits, meal delivery, services, or program participation. Program availability, benefits, and eligibility requirements vary by state, location, health plan, medical condition, funding availability, and applicable program rules.
